Competence, within the field of psychology, is as important as any other standard and possibly more important, because the knowledge available to clinicians is constantly growing and changing, making competency a lifelong goal that is never quite satisfied. Individuals and organizations are being judged by measures as old as civil society, but at the same time as new as the 21st century. The new measures are grounded in the age-old concept of ethics—the study of human conduct with emphasis on the determination of right and wrong. There is always more to learn and the thought of knowing all there is to know can be overwhelming.

Professional competency is not a fixed construct; it isn’t simply a choice between incompetence and competence. It is a continuum; there are many facets to competency, and being competent means having, in sufficient measure, the ability to perform, not just at an acceptable, required standard, but also in regards to one’s aspirational ethics. “Competency” can involve a lot of subjectivity: What is sufficient? How much is acceptable?

What is the standard? The answers are important, and sometimes hard learned—obtained out of conflict and consequences. The key question is: Will we learn fast enough and well enough to avoid the worst of the consequences?

OBJECTIVES

  • Review questions that encourage ethical thoughtfulness about issues related to competency and to suggest actions that can increase thought, reflection, and discussion of competence.
  • Identify external, and internal issues that are measures for assuring competence. “Law is the minimum ethic and, therefore, legal behavior is not necessarily the highest ethics.”
  • Recognize that it is incumbent upon the counseling profession and each counselor to prepare for new skills and update ongoing skills.
  • Address the laws and rules that are generally considered to uphold the lowest minimum standard for practice. Licensing laws, for example, protect patients from harm, but do not hold professionals accountable to a skill level that promotes quality.
  • Explore competency as the complex construct that it is and how it requires numerous measures to practice competently.
  • Examine together, as professionals, individually and collectively the questions related to competency measurement.
  • Utilize processes for maintaining aspirational ethics that promote the ability to practice within required ethical competencies, acting in line with core values and beliefs essential to competency.

ABOUT THE SPEAKER

Lois Fenner, R.N., M.S., Attorney at Law is an honors graduate of the University of Maryland School of Nursing Graduate School and the University of Maryland School of Law. She is an attorney and Certified Registered Nurse, Clinical Specialist. Ms. Fenner- McBride is a member of the Maryland Trial Lawyers Association, The American Nurse Attorneys Association, Women’s Bar Association, past President of the Monumental City Bar Association, Phi Kappa Phi and Sigma Theta Tau Honor Societies and the National Exchange Club. She has been recognized by the Alliance of Black Women Attorneys with the 1997 Distinguished Women in Law Award, the Baltimore Marketing Association Harold Young Leadership Award in 2000, and the Baltimore County Diversity Award in 2001. Additionally, she is a three-time recipient of the Daily Record’s Top 100 Women in Maryland Award, and has been recognized as a Baltimore Business Journal’s Who’s Who in Law in 2003. She was selected as one of the Super Lawyers in 2009 and 2010. Her practice focuses on medical litigation and health care to include medical malpractice, personal injury, accreditation, workers compensation, wrongful death and licensure issues.
